Quebec Appellate Court controversially lifts seizure of Air India’s funds held by IATA

On 20 September 2022, the Cour d’appel of Quebec (Canada) annulled the seizure by garnishment before trial of Air India’s funds (held by a third party, the International Air Transport Association) on the ground that there was insufficient evidence to pierce the corporate veil. In doing so, the Court controversially rejected the sufficiency of the sole justification that had been offered in support of the request to seize Air India’s assets: that the company is the alter ego of the Republic of India.
