PCA Tribunal decides it has no jurisdiction over claim against the Czech Republic because claimant had ceased to be an investor when arbitration proceedings commenced

In its Award dated 2 March 2022, a Permanent Court of Arbitration (PCA) Arbitral Tribunal, relying on Article 21 (1) and (4) of the Arbitration Rules of the United Nations Commission on International Trade Law (UNCITRAL Arbitration Rules), decided that “it has no jurisdiction to entertain the Claimant’s claim,” and ordered the Claimant, Alcor Holdings Ltd (Alcor), to pay the Tribunal’s and the PCA’s costs as well as the amount of EUR 146,267.97 to the Respondent together with the sum of EUR 637,225 in respect of the latter’s legal costs.
