Irish court refuses to refer parties to arbitration in €40 million battle of the forms

30 November 2022, DUBLIN. Following a protracted “battle of the forms,” the High Court of Ireland has refused to refer commercial parties to arbitration pursuant to Article 8 of the UNCITRAL Model Law on International Commercial Arbitration after finding that no arbitration agreement was incorporated into any of the conflicting terms and conditions alleged to govern their contract.
