ICSID Tribunal "Not Satisfied" that intra-EU arbitration is incompatible with EU Law, rejects Germany's claim under ICSID Arbitration Rule 41(5)

On 18 January 2022, the Tribunal in Mainstream Renewable Power Ltd and others v. Federal Republic of Germany (ICSID Case No. ARB/21/26), rejected Germany's application to dismiss all of the claims filed by Claimants for manifest lack of jurisdiction under Rule 41(5) of the ICSID Arbitration Rules.
