ICSID Tribunal grants EU Commission leave to file written submission as non-disputing party

On 15 June 2022, the Arbitral Tribunal in Encavis and others v Italy, ICSID Case No. ARB/20/39, decided to allow the European Commission to file a written submission as a non-disputing party on the EU law issues concerning the Tribunal’s jurisdiction.
