Colombia fails to satisfy ICSID Committee that Tribunal committed ‘annullable error’ in excluding alleged evidence of corruption

On 22 September 2021, the ICSID ad hoc committee in Glencore and Prodeco v Colombia delivered its ‘Decision on Annulment.’

In doing so, the Committee upheld the Tribunal’s decision to dismiss Colombia’s claims that the Glencore / Prodeco procured the three-hectare ‘La Jagua’ concession area in a fraudulent and corrupt manner in violation of Columbia’s laws.
