On 25 January 2022, the Court of Justice of the European Union annulled the 2019 judgment handed down by the General Court, finding that the lower court had erred by declaring that the European Commission lacked jurisdiction to examine, in the light of State aid regulations, the compensation paid by Romania to Swedish investors in the context of the enforcement of an arbitral award delivered by an Arbitral Tribunal under the auspices of ICSID.
