Odyssey v Mexico ICSID Tribunal denies application for leave to file a non-disputing party submission (amicus curiae)

On 20 December 2021, a majority of the ICSID Tribunal in Odyssey Marine Exploration, Inc. v. United Mexican States (ICSID Case No. UNCT/20/1) rejected the Sociedad Cooperativa de Producción Pesquera Puerto Chale S.C.L. (the Cooperativa) and the Center for International Environmental Law (CIEL) Joint Application to file a submission as amicus curiae in the arbitration proceedings concerning the Don Diego Project – a proposed underwater phosphorus mine off the coast of Mexico's Baja California Peninsula.
