ICSID Tribunal rejects request for interim measures against the Netherlands

In the ICSID Tribunal’s view, there is no conflict at this stage between Netherlands’ international law and EU law obligations. It therefore rejected Uniper’s request for provisional measures without recommending the withdrawal of the German Proceedings. In doing so, however, it also cautioned against any action that could aggravate the dispute or prevent the full and free continuation of the ICSID Arbitration and recommended that the need for continuing with the German Proceedings be reviewed.
