Kazakhstan succeeds in having fraud claims remanded to the New York State Supreme Court

On 10 February 2022, in the context of a series of cases commenced before the US Courts concerning the enforcement of an arbitral award rendered in 2013 by a Stockholm Chamber of Commerce (SCC) Arbitral Tribunal, the United States District Court for the Southern District of New York (the Court) held (Case 1:21-cv-03507-JGK) that it lacked subject matter jurisdiction to resolve the fraud claims brought by co-plaintiff Kazakhstan and remanded that action to the New York State Supreme Court.
